Acceptance of Terms

By accessing and using Bespoke Blend, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use this platform.

Registration and Account

To create and maintain a secure account, you must provide a valid email address and choose a unique username and password. Disposable or masked email addresses are not allowed.

During registration or use of our Services, we may request you to:
– verify your account details (e.g., phone number, email, payment method),
– provide additional relevant information,
– correct any inaccurate or incomplete account information, or
– answer security questions.

Each user is allowed only one account. However, if your original account is compromised and subsequently blocked, you may create a new one.

Failure to provide accurate information or to cooperate with verification requests may result in corrective action or account suspension.

User Responsibilities

As a user of Bespoke Blend, you confirm that you:
– are at least 18 years old,
– have an account,
– are legally authorized to conduct transactions,
– agree to these Terms and the Website Rules.

User Roles:
– Sellers can list goods (“Items”) for sale.
– Buyers can view, search for, and purchase Items, either individually or as part of a bundle, by initiating a transaction.

You must:
– comply with these Terms and all applicable laws,
– provide accurate, truthful, and up-to-date information,
– keep your login credentials confidential and report any unauthorized access,
– retain rights to all content you upload (photos, descriptions, etc.).

You must not:
– engage in illegal, unethical, or rights-infringing activities,
– use unauthorized tools (e.g., bots, scrapers),
– distribute malware or disrupt the platform,
– copy, sell, or commercialize content without permission,
– collect or misuse other users’ information,
– post offensive, unlawful, or discriminatory content,
– promote competing platforms or external websites.

Store Creation and Management

You must have the legal right to transfer ownership of an Item. All Items must comply with our Website Rules.

Commission Fee:
Bespoke Blend charges a 15% commission (exclusive of VAT) on each sale. This fee is deducted automatically at the time of payout and accompanied by an invoice sent to the seller’s email.

Shipping Fee:
As Bespoke Blend does not operate a warehouse and acts only as an intermediary, the seller is fully responsible for shipping. Shipping costs can be:
– included in the final item price,
– charged separately, or
– paid entirely by the seller.

A shipping cost guide is provided based on distance, weight, and volume. Bespoke Blend is not responsible for shipping and delivery.

Purchasing

To purchase an Item, you must:
– click the “Buy” button,
– select your payment method and delivery option,
– click the “Pay” button on the checkout page.

Payment Methods:
Payments can be made via:
– credit or debit card,
– other methods introduced on the platform.

Payment Processing:
We use third-party Payment Processors to manage online transactions.

Secure Holding:
Payments are held securely in a Bespoke Blend account until the transaction is completed. Upon completion, funds are released to the seller.

Fees:
The buyer pays:
– the item price,
– shipping costs (based on seller-buyer agreement),
– a Buyer Protection Fee:
 – 5% for orders under €100 (including VAT),
 – 3% for orders of €100 or more (including VAT).

Offline Purchases:
Transactions conducted outside the platform are not covered by Buyer Protection and are made at your own risk.

Product Listings and Quality

Sellers must upload original photos and accurate descriptions (not taken from the internet) of the items.

Listing an item constitutes an offer. A transaction is complete once the buyer clicks “Buy” and payment is accepted.

Shipping and Delivery

Buyers choose the shipping method at checkout. Sellers are solely responsible for delivery and tracking. Buyer Protection applies in case of lost items.

Returns, Refunds, and Cancellations

Buyer Protection ensures a refund if the item is:
– lost or damaged during shipping,
– significantly not as described (SNAD),
– counterfeit (SNAD counterfeit).

Reporting an Issue:
Report within 2 calendar days after delivery (Refund Request Period) via the “I have an issue” button. Failure to report within this period completes the transaction automatically.

For SNAD Items (excluding counterfeit):
– Try resolving the issue directly with the seller.
– If unresolved, escalate to Bespoke Blend.
– The seller may refund you directly or require a return within 5 business days.
– Buyers pay return shipping unless agreed otherwise.

For SNAD Counterfeit Items:
– Bespoke Blend investigates claims.
– If authenticity is confirmed, the transaction proceeds.
– If unclear, the case is canceled and a refund is issued.
– If counterfeit is confirmed, the refund is issued without requiring a return.

No Refund If:
– The item is not found to be SNAD,
– The issue was reported late,
– No sufficient evidence was provided,
– The item was used, washed, or altered,
– Buyer Protection was abused.

Account Termination

You may delete your account at any time.

We may suspend or block your account due to:
– legal violations,
– fraud,
– repeated or serious breaches of these Terms.

Blocked users can only contact Customer Support.

Corrective Actions and Account Blocking

If violations are detected, we may:
– send a warning,
– edit or remove items,
– restrict features,
– notify authorities.

Blocking may also occur due to:
– repeated violations,
– serious breaches (e.g., false info, security threats),
– flagged activity by Payment Processors or authorities.

Blocked accounts:
– cannot access the Site except to contact Support,
– have listings removed,
– forfeit seller service fees,
– may have pending transactions canceled,
– may be prevented from creating a new account.

Automated and Proportional Actions:
Actions may be taken via automated systems and will be proportional to the violation. We will notify you of:
– the reasons,
– the scope of restrictions,
– legal grounds and recourse options,
unless prohibited by law or investigations.

Immediate Blocking (without notice):
Occurs in cases of:
– serious safety or legal concerns,
– fraud, illegal content, or public security violations,
– suspicious activity or abuse of Site features.

Privacy Policy

Your data is processed to fulfill our obligations. We do our best to secure your data, but complete protection cannot be guaranteed. You share data at your own risk.

You allow Bespoke blend to have a non-exclusive, royalty-free (i.e. free of any payments by us to you) right to use your Content worldwide, during the applicable rights’ duration. This means we can copy, display and adapt Content for operational, commercial, advertising or other internal business purposes and on any type of platform or media including on television, in print media, on the Internet (in banners and articles, on other websites) and on social networks (Facebook, Twitter, Instagram, etc.).

Limitation of Liability

Bespoke Blend acts solely as a hosting platform and is not liable for transactions outside Buyer Protection. Users are responsible for tax obligations.

Modifications to Terms

We may update these Terms. For major changes, a 30-day prior notice will be given. Minor changes may occur without notice.

You may reject updates by closing your account.

Governing Law

These Terms are governed by the laws of your habitual residence. Disputes may be resolved via the European Commission or your local courts.

By registering and using the services of Bespoke Blend, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
